Terms of sale PrintPlaats.be / Manu-Mail NV
PrintPlaats.be version — based on Manu-Mail NV terms V1 - 18/11/2024
1. Commercial operator and digital application
Requests through PrintPlaats.be are commercially processed and fulfilled by Manu-Mail NV, I.Z. D’Helst 28, 9280 Lebbeke, which handles production, follow-up, invoicing, delivery and customer service.
The website and application were developed by Davy Langelet. Unless otherwise agreed in writing, intellectual property in the website, source code and technical implementation remains with the developer. Commercial activities and revenue from PrintPlaats.be belong to Manu-Mail NV.
2. Avoiding additional costs
To avoid extra costs, delays or corrections, supply production-ready files and data: address lists without filters or hidden rows, print-ready PDFs with 3 mm bleed where required, at least 300 dpi and embedded OpenType fonts. The customer checks content, spelling, addresses, quantities, sizes and specifications before confirmation.
3. Possible additional charges
Additional processing may be charged, with advance notice where possible: €15.00 per additional version or sheet or where foreign elements occur; preparation of lists, data or PDFs at €55.00 per hour; approved rush processing from 5,000 copies at €55.00; and a €75.00 administration fee for lodging a complaint with a third party.
4. Additional quote and pricing terms
Pricing may be adjusted if the work differs from the description, options, files or specifications. Unless stated otherwise, prices exclude 21% VAT, postage and transport. Quotes are non-binding and valid for 21 days; invoices are payable within 30 days.
Postage must be paid before postal handover and is not refundable unless agreed in writing. Reputation or brand damage claims are excluded. Maximum compensation is limited to the invoiced amount for Manu-Mail services, excluding postage and print produced by third parties.
5. Data accuracy and Mail ID
bpost requires at least 96% data accuracy for Mail ID terms and discounts. Failure may lead to charges or deductions by bpost. The customer remains responsible for the accuracy, completeness and lawfulness of address files; Manu-Mail is not responsible for interpretation or corrections applied by bpost.
6. General
Unless otherwise agreed in writing, these conditions prevail over customer terms. Unless expressly agreed in writing, the seller is not bound by an obligation to achieve a particular result.
7. Quotes
Quotes, quantities, possibilities, rates and lead times are non-binding. Address quantities are not guaranteed before execution. Online prices are indicative; direct mail, address files, postage, technical deviations, transport or courier delivery may require a final check.
8. Addresses
Address series remain the property of their supplier and are for the customer’s own use only. They may not be resold or disclosed. Reproduction makes four times the address price payable. Address series cannot be returned and are accepted as supplied; despite careful handling, 100% accuracy cannot be guaranteed.
9. Warranty
A normal percentage of waste must be accepted. Direct or indirect claims concerning lost postage or print, duplicate addresses, errors or omissions in address series are not accepted.
10. Transport
Goods travel at the customer’s cost and risk from the moment they leave our premises. Manu-Mail is not liable for postal, rail, carrier or courier delays; lead times are indicative unless agreed in writing.
Bpack, courier and distribution are transport or processing costs that may be subject to 21% VAT. Actual postage for named mail is handled separately and may be recharged without VAT.
11. Payment
Invoices are payable without discount within 30 days unless agreed otherwise in writing. Addresses and print may require cash or advance payment. Postage must be paid before postal handover. Work lasting more than one month may be invoiced monthly. Postal returns do not suspend payment.
12. Insurance of materials
Customer property not stored in our warehouses before, during or after processing is not covered by our insurance. Surplus material is returned carriage unpaid on request; without a request within 14 days after completion, it may be destroyed.
13. Complaints
Complaints must be sent by registered mail to Manu-Mail NV, I.Z. D’Helst 28, 9280 Lebbeke, within one week after delivery or the mailing date. Failure to take delivery starts this period from the invoice or dispatch note.
Compensation cannot exceed the amount of services performed by Manu-Mail, excluding postage and third-party print. A complaint does not suspend payment. Reputation and brand damage claims are excluded.
14. Disputes and jurisdiction
The courts of Dendermonde have exclusive jurisdiction and Belgian law applies, subject to mandatory legal provisions.
15. Penalty clause and default interest
Any invoice unpaid at maturity incurs, without prior notice, 12% annual interest and liquidated damages of 15% of the outstanding principal, with a minimum of €123.95, excluding judicial recovery costs. Agreed compensation may take the form of replacement or an invoice reduction.
16. Retention of title
Products remain the seller’s exclusive property until full payment. They may be reclaimed in the event of late payment.
17. Cancelling an order
Cancellation must be in writing and is valid only after explicit acceptance by Manu-Mail. Costs already incurred remain payable and will be invoiced.
18. Force majeure
Machine breakdowns, technical failures, strikes, bpost strikes, supplier or transport problems and other circumstances outside our control release the seller from liability. Manu-Mail may then withdraw from the commitment without compensation.
19. Print
Professional practices and general conditions of the printing industry as established by FEBELGRA, the Federation of the Belgian Graphic Industry, apply. All complaints are investigated.
20. Print and other proofs
The customer is responsible for correct files and carefully reviews all proofs. Approval of a personalised proof or print order confirms correct performance of preceding work. Colour differences between screen, proof and final product do not give rise to compensation.
21. Custom work and withdrawal
Print, personalised products and direct mail are made to the customer’s specifications and cannot be returned or cancelled once production, preparation or processing has begun.
22. Statutory warranty
The statutory warranty applies. Products must meet reasonable expectations taking account of specifications, technical limitations, supplied files and approved proofs. The customer remains responsible for file content and technical correctness; Manu-Mail may perform checks and request corrections.
23. Delivery
Delivery is by collection, bpost, Bpack, courier or other carrier. Lead times are indicative and external delays do not automatically result in compensation, refunds or cancellation.
The customer provides a complete, correct address and enables delivery. Returns or failed delivery caused by the customer do not qualify for compensation; return handling, storage or reshipping costs may be charged.
